The lawsuit alleges that Babbitt, a 35-year-old Air Force veteran, was "ambushed" by the U.S. Capitol Police officer who shot her without "any warnings or commands." Babbitt was climbing through the broken window of a barricaded door to the Speaker's Lobby when she was shot. The Department of Justice did not pursue criminal charges against Lt. Michael Byrd, the officer who shot her, while U.S. Capitol police said he would not face internal discipline. The lawsuit states that, when Babbitt was shot, she was unarmed and "posed no threat to the safety of anyone." According to the complaint, Byrd was not in uniform and did not identify himself as a police officer before he opened fire. The lawsuit also alleges no members of Congress were in the Speaker's Lobby at the time and that the area was guarded by multiple armed police officers. In an August 2021 television interview, Byrd told NBC News that he pulled the trigger as a "last resort." During the interview, Byrd said: "I tried to wait as long as I could. I hoped and prayed no one tried to enter through those doors. But their failure to comply required me to take the appropriate action to save the lives of members of Congress and myself and my fellow officers."

Just goes to show that anyone can sue anyone else, any time, for any reason. This has (too?) long been the case with US law. A better example would have been where New York changed its law to specifically allow Jean Carroll to sue Trump for defamation. An odd comment. The (D)OJ declined to do its job, so the family should just fuck off? Are we not fascist enough for you?

hopefully they win, byrd is a thug clown. babbitt was clearly unarmed and posed no threat that would justify the use of lethal force. she was seen casually chatting with police moments before the shooting.
with all that happened, only one clown pulled his gun and used it that day.

What a waste of attorney’s fees. It’s nuts watching all the people who defend police killing citizens be all up in arms about this.
Bet those same people thought the national guard was necessary during the 2020 Trump Race Riots.

And watch the next video I posted. The crowd was told to get back, and she didn't heed the call. The crowd knew he had a weapon and might shoot, she didn't stop and got killed.

The other policeman, who were standing between the crowd and the doors, simply decided to walk away from the doors.They didn't warn anybody either.

The police near her, that she was chatting with earlier, could have simply put some cuffs on her if she were some sort of a threat. Instead they chose to abandon their position, encouraging rioters.
